Lumavote (“the Service”, “we”, “us”) is a platform for running surveys and live votes. A host writes the questions and opens the session; participants join it with a code or link and submit responses. These Terms govern every use of the Service, on the free plan and on paid plans alike.

By creating an account or joining a session you agree to these Terms.

Hosts sign in with an email address or a Google account. You are responsible for what happens under your account and for keeping access to it secure. You must provide accurate information and be legally able to enter into this agreement.

Participants do not create accounts. A participant session is tied to the voting session it was issued for and expires with it.

You agree not to use the Service to:

· run unlawful, deceptive or fraudulent activity, including manipulated votes presented as genuine results;
· collect personal data from participants beyond what the Service itself collects, without a lawful basis of your own;
· upload content that infringes others’ rights, or that is abusive, hateful or harassing;
· probe, overload or disrupt the Service or attempt to access other customers’ data.

We may suspend or terminate accounts that violate these rules.

You keep all rights to the questions, images and other content you upload, and to the responses your sessions collect. You grant us the licence needed to host, process and display that content for the purpose of operating the Service — nothing more. You are responsible for having the rights to the content you upload.

Some features generate or grade content using large language models (see the Privacy Policy for how that data is handled). AI output can be wrong; review it before you rely on it, especially graded results you publish to participants.

Paid subscriptions are sold through our merchant of record, Paddle.com, which handles payment, tax and billing support. Prices, seat counts and billing intervals are shown at checkout. Subscriptions renew automatically until cancelled; you can cancel at any time and keep access until the end of the paid period. Refunds are handled per our Refund Policy.

We work to keep the Service available and to give notice of material changes, but the Service is provided “as is” without warranties of any kind. We may change or discontinue features; if a change materially reduces what a paid plan includes, you may cancel and request a pro-rata refund of the unused period.

To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages, and our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose (or USD 50 if you paid nothing). Nothing in these Terms limits liability that cannot lawfully be limited.

You can delete your account at any time. We may terminate or suspend access for breach of these Terms with notice where practicable. Sections that by their nature survive termination (content ownership, liability limits, governing law) survive it.

We may update these Terms. Continued use after an update is acceptance of the updated Terms. For material changes we will give hosts advance notice by email or in the product.
